Comedian Tracy Morgan is suing Wal-Mart over the deadly crash that left one dead and several injured on June 7.

In a lawsuit filed with the U.S. District Court in New Jersey, Morgan cites negligence on Wal-Mart’s behalf.  Kevin Roper, who was driving a Wal-Mart semi-truck, allegedly became tired while driving down the turnpike just after midnight on June 7 and didn’t have time to react to slowed traffic.

The accident claimed the life of Morgan’s friend James McNair and left Morgan in the hospital for weeks.

“Wal-Mart was careless and negligent in the ownership and operation of its motor vehicle, which caused Mr. Morgan to suffer severe personal injuries,” the complaint reads. “As a direct and proximate result of said collision, Mr. Morgan was caused to sustain severe painful bodily injuries, including but not limited to multiple fractures which required multiple surgeries, extensive medical treatment and will require significant physical rehabilitation.”

The plaintiff’s include McNair’s wife Krista Millea, Morgan’s assistant Jeffrey Millea and Ardie Fuqua.

They are suing for negligence and loss of consortium.  They are also seeking compensatory and statutory damages, punitive damages, legal fees as well as other things.

“Wal-Mart not only failed to condemn, but condoned this practice of its drivers routinely violating the F.M.S.C.A. Regulations,” the lawsuit continues.

After the lawsuit was filed, Wal-Mart said it is “committed to doing the right thing for all involved.”
